Mutual Recognition of authorisations granted by mutual recognition

During the ECHA Coordination Group CG-52 meeting, it was agreed that biocidal product authorisations granted in accordance with Article 32 of Regulation (EU) No 528/2012, can be recognised in other Member States subjected to a mutual recognition procedure, as established in Article 33 of the BPR. The relevant CG document “CG-52-2022-14 AP 7.2 Mutual Recognition of a mutual recognition_vf” is attached. Click here for the document.

I would like to ask your feedback on the following:

  • Why, or in which situation, would you opt to apply for a Mutual Recognition of an authorisation that was granted by Mutual Recognition?
  • Please point out the reasons and benefits of this compared to other application procedures.

Feedback and all information will be kept confidential. The intention is purely to understand better the challenges implied by this process, and to coordinate, if/as the case, to give feedback to ECHA Coordination Group.

Deadline is 4 September COB.
